In the decades since the slaughter of both soldiers and civilians in WWII and in the Shoah the international community has been at pains to tighten and enforce legally-meaningful ‘rules of war’. Former Heads of State have even found themselves on trial at the International Criminal Court in The Hague. And one of the key judgments as to whether military action is legitimate or not is ‘proportionality’, with Israel frequently accused of acting ‘disproportionately’. Hagai will explore this dynamic, and why - on both moral and legal grounds - such a characterisation might have dramatic future consequences for Israel and its decision-makers.
